These terms of service ("Terms") govern your use of custompacka.ing (the "site") operated by CustomPacka ("we", "us"), including our tools, community, accounts and digital products, and the purchase of custom packaging from us. By using the site or placing an order, you agree to these Terms. If you do not agree, please do not use the site.
1. Using the site
- You must be at least 18 years old, or the age of majority where you live, to create an account, post in the community or place an order.
- You agree to provide accurate information and to keep your account credentials secure. You are responsible for activity under your account.
- You may not misuse the site: no attempts to disrupt it, access it without authorization, scrape it in a way that burdens our systems, send spam, upload malware or use it for unlawful purposes.
2. Tools, estimates and information
Our calculators, 3D Box Builder, dieline generator, assistant, guides and price estimates are provided for planning and education. They use standard formulas and published pricing models but are estimates. They are not engineering certification, legal or regulatory advice, or a binding offer. Prices are confirmed only in a written quote. You are responsible for verifying that packaging is suitable for your product, shipping conditions and legal requirements.
3. Quotes and orders
- Quotes are valid for the period stated on the quote (30 days unless stated otherwise) and are based on the specifications, quantities and delivery details you provide. Changes may change the price.
- Orders are accepted when we confirm them in writing after you accept a quote. Production starts after you approve the proof and payment (or an agreed deposit) is received.
- Quantities: custom production may result in small overruns or underruns. Any tolerance stated in your quote applies, and you are billed for the quantity delivered within it.
- Timelines are estimates based on typical production and transit times. We will tell you promptly about delays. We are not liable for delays caused by events beyond our reasonable control.
4. Proofs and approval
You are responsible for reviewing proofs carefully, including spelling, content, barcodes, dimensions, colors and regulatory information. Your approval confirms that the proof is correct. We are not responsible for errors that appear in an approved proof. Screen colors and digital proofs are not exact representations of printed color; normal printing tolerances apply.
5. Your artwork and content
- You confirm that you own or have permission to use all artwork, logos, trademarks, images and text you send us, and that printing them does not infringe anyone's rights or break any law.
- You grant us a limited license to use your files to prepare proofs, produce and deliver your order and provide support.
- We may decline orders that we believe infringe rights or contain unlawful, hateful or harmful content.
- We will not show your packaging in our portfolio or marketing without your permission.
6. Labeling and compliance
You are responsible for ensuring that your packaging and labeling comply with all laws and regulations that apply to your product and markets (for example FDA, FTC, CPSC and state requirements). Our artwork checks focus on print quality and are not a regulatory review. Tell us if packaging will contact food or requires special materials.
7. Payment
Prices are in US dollars. Payment terms are stated in your quote. Taxes may apply depending on your location and the nature of your purchase. Digital products and memberships are sold through our checkout provider, which may act as the merchant of record and apply its own terms.
8. Delivery, risk and inspection
Delivery terms are described in our shipping policy. Risk of loss passes to you on delivery. Please inspect your order on arrival and report problems as described in our reprint guarantee.
9. Reprint guarantee and remedies
If goods have a production defect or do not match the approved proof, our reprint guarantee describes your remedy: reprint or refund of the affected items. To the extent permitted by law, this is your exclusive remedy for defective goods.
10. Community rules
When you post in the community, review us or submit other content:
- Be respectful and helpful. No harassment, hate speech, threats or personal attacks.
- No spam, self-promotion beyond what is allowed in the community guidelines, or misleading content.
- Do not post others' personal information or confidential information.
- Only post content you have the right to share.
- Reviews must reflect your genuine experience as a customer.
You keep ownership of what you post, and you grant us a non-exclusive, worldwide, royalty-free license to display, distribute and moderate it on the site. We may edit, hide or remove content and suspend accounts that break these rules.
11. Digital products and memberships
Digital products are licensed, not sold. You may use them in your own projects and your clients' projects, including commercial packaging and marketing, but you may not resell, share, sublicense or redistribute the files themselves or include them in competing template products. Memberships renew automatically until cancelled; you can cancel at any time and access continues to the end of the paid period.
12. Intellectual property
The site, including its design, text, graphics, tools, code, images and the CustomPacka name and logo, belongs to us or our licensors and is protected by intellectual property laws. You may not copy or reuse it except as allowed by these Terms or with our written permission. Linking to our pages is welcome.
13. Disclaimers
The site and its tools are provided "as is" and "as available". To the extent permitted by law, we disclaim all warranties not expressly stated in these Terms or your order confirmation, including implied warranties of merchantability and fitness for a particular purpose.
14. Limitation of liability
To the extent permitted by law, we are not liable for indirect, incidental, special, consequential or punitive damages, or lost profits, revenue or data. Our total liability for any claim relating to an order is limited to the amount you paid for that order, and for any other claim to US $100.
15. Indemnity
You agree to indemnify us against claims, losses and costs (including reasonable legal fees) arising from your artwork or content, your products, your breach of these Terms or your violation of any law or third-party right.
16. Disputes
If you have a concern, please contact us first at hello@custompacka.ing. Most issues can be resolved quickly and informally, and we will work in good faith to do so. If a dispute cannot be resolved informally, it will be handled under the laws and in the courts that apply, without regard to conflict-of-law rules, unless mandatory consumer protection law in your place of residence provides otherwise.
17. Changes
We may update these Terms from time to time. The "last updated" date shows the current version. Changes apply to orders placed and use of the site after the update.
